John Huber is the father of Anthony Huber who was killed during looting, rioting, and vandalism by Black Lives Matter protesters in Kenosha, Wisconsin in 2020.<\/p>\n

Anthony Huber was killed when he attacked then-17-year-old Kyle Rittenhouse during the riots.<\/p>\n

Huber was shot dead when he tried to beat Kyle Rittenhouse to death with a skateboard.<\/p>\n\n

Rittenhouse was later exonerated of any wrongdoing by a Wisconsin jury of his peers.<\/p>\n

Following the verdict, John Huber said the jury\u2019s verdict added insult to injury. <\/p>\n\n

Now he\u2019s suing Rittenhouse for wrongful death. The family believes Anthony had the right to beat Kyle to death at the riots.<\/p>\n

The AP<\/a> reported:<\/p>\n

A federal judge in Wisconsin on Wednesday ruled that a wrongful death lawsuit filed by the father of a man shot and killed by Kyle Rittenhouse during a protest in 2020 can proceed against Rittenhouse, police officers and others.<\/p>\n

The father of Anthony Huber, one of two men shot and killed by Rittenhouse, filed the lawsuit in 2021, accusing officers of allowing for a dangerous situation that violated his son\u2019s constitutional rights and resulted in his death. Anthony Huber\u2019s father, John Huber, also alleged that Rittenhouse, who was 17 at the time of the shootings, conspired with law enforcement to cause harm to protestors. John Huber is seeking unspecified damages from city officials, officers and Rittenhouse.<\/p>\n

U.S. District Judge Lynn Adelman on Wednesday dismissed motions filed by Rittenhouse and the government defendants seeking to dismiss the civil rights lawsuit.<\/p>\n

In allowing the case against Rittenhouse and the others to proceed, the judge said that Anthony Huber\u2019s death \u201ccould plausibly be regarded as having been proximately caused by the actions of the governmental defendants.\u201d<\/p>\n

Rittenhouse attorney Shane Martin said in a phone interview that it\u2019s important to note the ruling doesn\u2019t address the merits of the case, it only allows it to proceed to the next phase.<\/p>\n
