Files Lawsuit Against California Over Content Moderation Law, Argues it Violates First Amendment"},"content":{"rendered":"<h3>Elon Musk\u2019s X Corp. has filed a lawsuit against California over the state\u2019s content moderation law.<\/h3>\n<p>X\u2019s complaint, which was filed on Friday, argues that the law violates the First Amendment.<\/p>\n<p>X\u2019s Global Government Affairs team wrote of the lawsuit, \u201cToday, @X filed a First Amendment lawsuit against California AB 587. As made clear by both the legislative history and public court submissions from the Attorney General in defending the law, the true intent of AB 587 is to pressure social media platforms to \u2018eliminate\u2019 certain constitutionally-protected content viewed by the State as problematic.\u201d<\/p>\n<p>Today, <a href=\"https:\/\/twitter.com\/X?ref_src=twsrc%5Etfw\">@X<\/a> filed a First Amendment lawsuit against California AB 587. As made clear by both the legislative history and public court submissions from the Attorney General in defending the law, the true intent of AB 587 is to pressure social media platforms to \u201celiminate\u201d certain\u2026<\/p>\n<p>\u2014 Global Government Affairs (@GlobalAffairs) <a href=\"https:\/\/twitter.com\/GlobalAffairs\/status\/1700276192237003006?ref_src=twsrc%5Etfw\">September 8, 2023<\/a><\/p>\n\n<p>Assembly Bill No. 587 was signed into law by California Governor Gavin Newsom last year.<\/p>\n<p>The Verge <a href=\"https:\/\/www.theverge.com\/2022\/9\/14\/23353321\/gavin-newsom-ab587-social-network-misinformation-law\">reported<\/a> at the time the bill was signed, \u201cAB 587 requires social media companies to post their terms of service online, as well as submit a twice-yearly report to the state attorney general. The report must include details about whether the platform defines and moderates several categories of content, including \u2018hate speech or racism,\u2019 \u2018extremism or radicalization,\u2019 \u2018disinformation or misinformation,\u2019 harassment, and \u2018foreign political interference.\u2019 It must also offer details about automated content moderation, how many times people viewed content that was flagged for removal, and how the flagged content was handled. It\u2019s one of several recent California plans to regulate social media, also including AB 2273, which is intended to tighten regulations for children\u2019s social media use.\u201d<\/p>\n<p>X\u2019s lawsuit argues that \u201cAB 587 violates X Corp.\u2019s First Amendment right to not speak about controversial topics and to decide for itself what it will say or not say about these topic.\u201d<\/p>\n<p>California State Assemblymember Jesse Gabriel, the author of the bill, argued in true authoritarian form that if X, formerly known as \u201cTwitter,\u201d has \u201cnothing to hide\u201d then they should have no objection to his bill.<\/p>\n<p>\u201cAssembly Bill 587 is a pure transparency measure that simply requires companies to be upfront about if and how they are moderating content.
