An appeals court wiped out a conviction of a former Congressman after defense lawyers argued the FBI \u201cset up\u201d the lawmaker. <\/p>\n

Nebraska GOP Congressman Jeff Fortenberry last year resigned<\/a> from Congress after being\u00a0convicted\u00a0<\/a>of lying to the FBI.<\/p>\n

\u201cDue to the difficulties of my current circumstances, I can no longer serve you effectively,\u201d Fortenberry said in a\u00a0statement<\/a>.<\/p>\n

Kevin McCarthy joined then-Speaker Pelosi and called for Fortenberry to step down last year.<\/p>\n

\u201cI think when someone\u2019s convicted, it\u2019s time to resign,\u201d McCarthy told reporters last year, according to\u00a0Politico<\/a>.<\/p>\n

\u201cCongressman Fortenberry\u2019s conviction represents a breach of the public trust and confidence in his ability to serve. No one is above the law,\u201d Pelosi, a lifelong crook who mysteriously made hundreds of millions of dollars as a member of Congress said last year.<\/p>\n

Fortenberry was convicted on three felony counts \u2013 one count of falsifying and concealing material facts and two counts of making false statements (each count carries five years) by a federal grand jury in Los Angeles.<\/p>\n

Fortenberry\u2019s lawyers argued at trial that the FBI lured the Congressman into giving two interviews \u2013 then indicted him after he couldn\u2019t remember all the details about a conversation he had with an FBI informant about the illicit campaign donation.<\/p>\n

\u201cDefense lawyers said the FBI \u201cset up\u201d Fortenberry after a national investigation fizzled into foreign money funneled to members of Congress. They said Fortenberry\u2019s flaw was voluntarily meeting with agents and prosecutors to help their probe and having a faulty memory.\u201d \u2013 AP reported<\/a>.<\/p>\n

Nebraska Governor Pete Ricketts called a special election to fill Fortenberry\u2019s vacant seat.<\/p>\n

Now this\u2026<\/strong><\/p>\n

The Ninth Circuit Court of Appeals wiped out Fortenberry\u2019s conviction after his defense lawyers argued the FBI set him up.<\/p>\n

The appeals court said the FBI interviews took place in Nebraska at Fortenberry\u2019s home and in DC. Meanwhile, a Los Angeles jury convicted Fortenberry of the alleged crimes that took place in another state.<\/p>\n

\u201cFortenberry\u2019s trial took place in a state where no charged crime was committed, and before a jury drawn from the vicinage of the federal agencies that investigated the defendant,\u201d US District Judge James Donato wrote in the opinion<\/a>.<\/p>\n

\u201cThe Constitution does not permit this. Fortenberry\u2019s convictions are reversed so that he may be retried, if at all, in a proper venue,\u201d the opinion read.<\/p>\n

\u201cWe are gratified by the Ninth Circuit\u2019s decision. Celeste and I would like to thank everyone who has stood by us and supported us with their kindness and friendship,\u201d Fortenberry said in a statement<\/a>.<\/p>\n
