A federal appeals court on Tuesday denied X\u2019s challenge to Special Counsel Jack Smith\u2019s secret search warrant for Trump\u2019s X account.<\/p>\n

As previously reported, Special Counsel Jack Smith admitted he included inaccurate information when he asked Judge Beryl Howell, an Obama appointee, for a\u00a0secret search warrant<\/a>\u00a0for Trump\u2019s X\/Twitter account @RealDonaldTrump.<\/p>\n

X was fined $350,000 because it delayed producing the subpoenaed records.<\/p>\n

The search warrant was so secret that Trump didn\u2019t even know Jack Smith issued a subpoena for the records.<\/p>\n

Biden\u2019s corrupt Justice Department obtained a nondisclosure order that prohibited X from informing Trump about Jack Smith\u2019s subpoena.<\/p>\n

Over the course of the months-long legal battle, X argued that the nondisclosure order violated the First Amendment and Stored Communications Act.<\/p>\n

The Justice Department argued Trump would put the so-called \u2018ongoing investigation\u2019 in jeopardy.<\/p>\n

In August the DC Circuit Court Appeals said the court found that there were \u201creasonable grounds to believe\u201d that Trump would \u2018jeopardize the ongoing investigation\u2019 if he knew about the search warrant.<\/p>\n

\u201cThe district court, according to the DC Circuit\u2019s opinion, \u201cfound that there were \u2018reasonable grounds to believe\u2019 that disclosing the warrant to former President Trump \u2018would seriously jeopardize the ongoing investigation\u2019 by giving him \u201can opportunity to destroy evidence, change patterns of behavior, [or] notify confederates.\u201d\u201d CNN reported in August.<\/a><\/p>\n

Jack Smith\u00a0admitted<\/a>\u00a0to Judge Howell he included inaccurate<\/em> information when he suggested Trump would become a flight risk if he learned about the secret gag order.<\/p>\n

A month later in September, X asked for a hearing before the DC Circuit Court of Appeals\u2019 entire court of 11 judges (en banc).<\/p>\n

The Court\u2019s 11 judges denied X\u2019s challenge on Tuesday, but the 4 conservative judges offered up a scathing condemnation of Jack Smith, Judge Pan and Judge Beryl Howell for their decision to circumvent executive privilege. <\/p>\n

The 4 conservative judges from the DC Circuit Court of Appeals scorched Jack Smith, Judge Beryl Howell (District Judge) and Judge Florence Pan (Biden-appointed federal judge on appeals court) for bypassing the assertion of executive privilege when they obtained a secret search warrant for Trump\u2019s X account.<\/p>\n

\u201cThe Special Counsel\u2019s approach obscured and bypassed any assertion of executive privilege and dodged the careful balance Congress struck in the Presidential Records Act.\u201d \u2013 Judge Naomi Rao wrote in a statement joined by the 3 other conservative judges on Tuesday.<\/p>\n

Jack Smith and the Biden DOJ also\u00a0demanded information<\/a>\u00a0on all Twitter-X users who retweeted President Trump, liked President Trump\u2019s tweets, or mentioned President Trump\u2019s account in their tweets.<\/p>\n
