{"id":25587,"date":"2024-02-27T14:42:24","date_gmt":"2024-02-27T14:42:24","guid":{"rendered":"https:\/\/sasquatchnewsonline.com\/?p=25587"},"modified":"2024-02-27T14:42:24","modified_gmt":"2024-02-27T14:42:24","slug":"queensland-supreme-court-rules-covid-vaccine-mandates-for-police-and-paramedics-unlawful","status":"publish","type":"post","link":"https:\/\/sasquatchnewsonline.com\/?p=25587","title":{"rendered":"Queensland Supreme Court Rules COVID Vaccine Mandates for Police and Paramedics Unlawful"},"content":{"rendered":"<p>In a landmark decision, the Queensland Supreme Court has ruled that the COVID-19 vaccine mandates for police officers and paramedics were unlawful.<\/p>\n<p>Justice Glenn Martin delivered a detailed 115-page judgment on Tuesday, stating that the directives issued by Police Commissioner Katarina Carroll and John Wakefield, director general of Queensland Health, violated the Human Rights Act.<\/p>\n<p>The contentious mandate required all police and health workers, including paramedics, to be vaccinated against COVID-19 as a condition of their employment.<\/p>\n<p class=\"mb-2 last:mb-0\">Justice Martin\u2019s ruling effectively nullifies the December 2021 mandate, preventing Commissioner Carroll and Mr. Wakefield from enforcing the vaccination policy.<\/p>\n<p class=\"mb-2 last:mb-0\">Seventy-four personnel, who staunchly resisted the compulsory vaccinations, mounted a legal challenge against the state government, culminating in three separate legal proceedings, <a href=\"https:\/\/www.couriermail.com.au\/subscribe\/news\/1\/?sourceCode=CMWEB_WRE170_a_GGL&amp;dest=https%3A%2F%2Fwww.couriermail.com.au%2Ftruecrimeaustralia%2Fpolice-courts-qld%2Fsupreme-court-bombshell-qlds-mandatory-covid-vaccine-orders-unlawful%2Fnews-story%2F4dcc6ca18dae261249fd7988642192fb&amp;memtype=anonymous&amp;mode=premium&amp;v21=HIGH-Segment-1-SCORE#:~:text=In%20a%20115-page%20decision,steps%20to%20enforce%20the%20direction.\">The Courier Mail<\/a> reported.<\/p>\n<p class=\"mb-2 last:mb-0\">These cases were meticulously reviewed by the court, with two concerning police officers and civil staff, and one involving Queensland Ambulance Service employees.<\/p>\n<p class=\"mb-2 last:mb-0\">During the legal proceedings, the involved workers were exempt from the vaccination requirement, allowing them to continue their duties unvaccinated.<\/p>\n<p><a href=\"https:\/\/www.brisbanetimes.com.au\/national\/queensland\/police-service-health-department-bungled-vaccine-mandates-judge-finds-20240227-p5f85p.html\">Brisbane Times<\/a> reported:<\/p>\n<p>The judgments did not make a ruling or attempt to make a decision about the transmissibility of a particular variant of COVID-19 or the efficacy of a particular vaccine.<\/p>\n<p>The prior directions required emergency service workers to receive COVID-19 vaccines and booster shots or face potential disciplinary action up to and including termination of employment.<\/p>\n<p>The court found Police Commissioner Katarina Carroll failed to give proper consideration to human rights relevant to the decision to issue the vaccine mandate.<\/p>\n<p>Former Department of Health director-general Dr John Wakefield was unable to prove he issued the vaccine mandate under an implied term of the employment agreements for ambulance service workers.<\/p>\n<p>As a result, both vaccine mandates were found by the court to be \u201cunlawful\u201d and to have no effect.<\/p>\n<p>The court also found the directions limited the human rights of workers because they were required to undergo a medical procedure without full consent but it was reasonable in all the circumstances.<\/p>\n<p>Senator Malcolm Roberts of Queensland took to the media, proclaiming the court\u2019s decision as a significant victory.<\/p>\n<p>\u201cGreat news.
