Way back in January 2019, TV actor Jussie Smollett<\/a> became entangled in a web of lies in his detestable hoax in which he pretended to have been racially targeted and assaulted.<\/p>\n

In a very long-lasting Cook County judicial process, Smollett ended up charged and convicted (in 2021) of five counts of disorderly conduct \u2013 and his conviction was later confirmed by an Illinois appellate court.<\/p>\n

But the story is not over because the disgraced actor is taking his fight to the Illinois Supreme Court.<\/p>\n

Prosecutor Dan Webb has responded to Smollett\u2019s appeal, and of course it got leaked to the media.<\/p>\n

TMZ<\/a> reported:<\/p>\n

\u201c<\/em>Jussie Smollett doesn\u2019t understand the law, and he\u2019s barking up the wrong tree with the Illinois Supreme Court\u2026 at least that\u2019s how the special prosecutor views the actor\u2019s appeal.<\/p>\n

Special prosecutor Dan Webb \u2014 who convicted Jussie for lying to cops about the hate crime hoax \u2014 is responding to Jussie\u2019s motion to have the IL Supreme Court review his case and overturn the conviction \u2026 and says JS\u2019s claim he had an agreement in place to avoid prosecution simply doesn\u2019t hold water.\u201d<\/p>\n

Jussie Smollett claims he had an (unsigned) deal with the Cook County State\u2019s Attorney\u2019s Office, in which he would do volunteer community service and forfeit his bond \u2013 and in return, prosecutors would drop the charges.<\/p>\n

\u201cHowever, Webb says that \u2018agreement\u2019 was \u2018imaginary\u2019 on Smollett\u2019s part, and it did not insulate him from facing charges at a later date. Webb also shoots down Jussie\u2019s claim he\u2019s a victim of double jeopardy \u2014 pointing out the legal term doesn\u2019t apply in this case.<\/p>\n

In docs, obtained by TMZ, the special prosecutor says protection from double jeopardy is \u2018triggered only after the accused has been subjected to the hazards of trial and possible conviction\u2019.\u201d<\/p>\n

The initial charges were dropped before there was any jury impaneled, any witnesses sworn in, or any evidence produced.<\/p>\n

\u201cSpecial prosecutor Webb\u2019s overall point\u2026 Jussie\u2019s case isn\u2019t worthy of an IL Supreme Court review. Webb would like to see the high court reject his bid for appeal, opening the door for Jussie to complete his 150-day sentence \u2026 of which he\u2019s only served 6, so far.\u201d<\/p>\n

The actor works to exhaust all his appeal options after a jury in 2021 convicted him on five of six counts of disorderly conduct.<\/p>\n

His sentence was 150 days in jail, 30 months of probation, and $130,160 in restitution.<\/p>\n

AOL<\/a> reported:<\/p>\n

\u201c<\/em>Smollett\u2019s attorneys filed the petition to the high court [\u2026] arguing that the questions raised by the case have the \u2018potential for wide-reaching implications\u2019 across Illinois. The court has the discretion to decide whether to take the case, or leave the appellate court\u2019s decision in effect.<\/p>\n

[\u2026] Smollett\u2019s petition to the Supreme Court argues that the lower court\u2019s opinion \u2018threatens to upend all informal and formal deferred prosecution agreements\u2019.<\/p>\n

\u2018What should have been a straightforward case has been complicated by the intersection of politics and public outrage\u2019, the petition says.\u201d<\/p>\n
