Lawyers representing Hunter Biden asked Monday for a new trial following his conviction last week on charges he lied about his drug use to buy a gun \u2014 only to withdraw the request minutes later.<\/p>\n
Convicted felon<\/a> Hunter Biden and his lawyers initially filed documents in Delaware federal court on Monday morning. They claimed that Judge Maryellen Noreika, who presided over the trial, lacked jurisdiction due to pending rulings by the Philadelphia-based Third Circuit Court of Appeals, Gazette<\/a> reported.<\/p>\n Judge Noreika, who was appointed to the bench by former President Donald Trump, had previously dismissed several motions<\/a> to drop the charges against Biden, including the defense\u2019s argument that the case violated Biden\u2019s Second Amendment rights.<\/p>\n A three-judge panel upheld Noreika\u2019s rulings, but the appeals court has yet to rule on a request for reconsideration by the full Third Circuit.<\/p>\n According to New York Post<\/a>, in the initial filing, Biden\u2019s lawyer Abbe Lowell stated, \u201cThe Third Circuit, however, did not then and has not yet issued its mandate as to the orders dismissing either appeal. Thus, when this Court empaneled the jury on June 3, 2024 and proceeded to trial, it was without jurisdiction to do so.\u201d<\/p>\n However, moments later it was revealed that the motion had been mysteriously deleted. A note in the court docket stated, \u201cThe Motion for a New Trial\u2026 has been deleted at the request of counsel,\u201d describing it as a \u201ccorrecting entry.\u201d The reason for this sudden withdrawal remains unclear.<\/p>\n More from the New York Post<\/a>:<\/p>\n The Third Circuit\u00a0rejected one of Hunter\u2019s appeals<\/a>\u00a0on May 9, finding it couldn\u2019t make a ruling before trial.<\/p>\n The appellate court\u00a0on May 28\u00a0also\u00a0shot down the Biden scion\u2019s\u00a0other\u00a0bid<\/a>\u00a0to toss the three gun charges he faced,\u00a0finding that it couldn\u2019t rule before a jury verdict.<\/p>\n Hunter, 54,\u00a0<\/a>was found guilty June 11 of falsely claiming he didn\u2019t use drugs when he bought a .38-caliber Colt Cobra revolver on Oct. 12, 2018, when he was actually hooked on crack cocaine at the time.<\/p>\n He\u00a0faces up to 25 years behind bars<\/a>\u00a0at his sentencing.\u00a0Noreika\u00a0has yet to set a sentencing date.<\/p>\n A\u00a0spokesperson for special counsel David Weiss\u2019 office declined to comment.<\/p>\n Lowell didn\u2019t immediately return a request for comment on why he withdrew the motion for a new trial.<\/p>\n Last week, Hunter Biden dropped his lawsuit<\/a> against former New York City Mayor Rudy Giuliani and Robert Costello, the former lawyer of the ex-New York City mayor. The lawsuit accused them of manipulating data found on Biden\u2019s infamous laptop from hell.<\/p>\n In September 2023, Hunter Biden\u00a0filed a civil lawsuit<\/a>\u00a0in a federal court in California against Rudy Giuliani and his former lawyer, Robert Costello, claiming they violated state and federal computer privacy laws when they \u2018hacked into\u2019 his laptop.<\/p>\n Biden\u2019s lawyer, Abbe Lowell, filed the stipulation for dismissal on Thursday in the US District Court for the Southern District of New York.
