Jack Smith on Monday moved to dismiss both federal cases against President Trump as Trump plans to go scorched earth and fire the special counsel\u2019s entire team of prosecutors.<\/p>\n

Jack Smith asked to dismiss both the January 6 case and classified documents case against President Trump.<\/p>\n

In June 2023, Jack Smith indicted Trump on 37 federal counts in Miami for lawfully storing presidential records at his Mar-a-Lago estate which was protected by Secret Service agents.<\/p>\n

In July 2023 Jack Smith hit Trump with\u00a03 additional charges<\/a>\u00a0in the investigation into classified documents stored at Mar-a-Lago. The\u00a0superseding indictment<\/a>, filed in the Southern District of Florida, claims Trump was part of a scheme to delete security footage from Mar-a-Lago.<\/p>\n

In September 2023 Trump was hit with\u00a04 counts<\/a>\u00a0in Jack Smith\u2019s January 6 case up in DC: Conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.<\/p>\n

Jack Smith moved to dismiss both cases and said due to the nature of the immunity afforded a sitting President, it does not require dismissal with prejudice.<\/p>\n

\u201cAs a result of the election held on November 5, 2024, the defendant, Donald J. Trump, will be inaugurated as President on January 20, 2025. It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President,\u201d Jack Smith wrote.<\/p>\n

\u201cAfter careful consideration, the department has determined that [the Office of Legal Counsel\u2019s] prior opinions concerning the Constitution\u2019s prohibition on federal indictment and prosecution of a sitting president apply to this situation and that as a result this prosecution must be dismissed before the defendant is inaugurated. That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the government\u2019s proof, or the merits of the prosecution, which the government stands fully behind,\u201d Jack Smith wrote in the government\u2019s motion to dismiss<\/a> reviewed by The Gateway Pundit.<\/p>\n

Last week it was reported<\/a> that President Trump plans to fire Jack Smith\u2019s entire team of prosecutors and will use the Justice Department to investigate the 2020 election.<\/p>\n

The Washington Post<\/a>, citing Trump Transition sources, reported that Trump will fire Jack Smith\u2019s team of activist lawyers and use the DOJ to assemble a team to investigate the stolen 2020 election.<\/p>\n

\u201cPresident-elect Donald Trump plans to fire the entire team that worked with special counsel Jack Smith to pursue two federal prosecutions against the former president, including career attorneys typically protected from political retribution,\u201d WaPo reported.<\/p>\n

\u201cTrump is also planning to assemble investigative teams within the Justice Department to hunt for evidence in battleground states that fraud tainted the 2020 election,\u201d WaPo reported.<\/p>\n

Jack Smith\u2019s team of taxpayer-funded prosecutors were operating in secret. Smith\u2019s team of lawyers was\u00a0DOUBLE the size<\/a>\u00a0of Mueller\u2019s (Weissmann\u2019s) team.<\/p>\n

Mueller had a team of a dozen angry Democrats and Hillary Clinton donors harassing Trump for two years.<\/p>\n

President Trump\u2019s DOJ should publicly name and fire every single one of Jack Smith\u2019s prosecutors.<\/p>\n

Trump\u2019s senior advisor Steven Cheung released a statement after Jack Smith moved to dismiss both cases against Trump.<\/p>\n
