In keeping with my oath and duty to Constitution and country, I affirm what I believe and what three-fourths of the states have ratified: the 28th Amendment is the law of the land, guaranteeing all Americans equal rights and protections under the law regardless of their sex,\u201d Biden\u00a0<a href=\"https:\/\/www.npr.org\/2025\/01\/17\/nx-s1-5264378\/biden-era-national-archivist-constitution\">said<\/a> in a statement.<\/p>\n<p>CNN\u00a0<a href=\"https:\/\/www.cnn.com\/2025\/01\/17\/politics\/joe-biden-equal-right-amendment\/index.html\">reports<\/a>\u00a0that Biden\u2019s move will draw swift legal challenges, because ratification for the Equal Rights Amendment (ERA) expired June 30, 1982, over 40 years ago.<\/p>\n<p>Moreover Biden\u2019s own Justice Department agrees. In 2022, they\u00a0<a href=\"https:\/\/constitutioncenter.org\/blog\/can-the-equal-rights-amendment-be-brought-back-to-life#:~:text=The%20Archivist%20cited%20opinions%20from,longer%20pending%20before%20the%20states.\">affirmed<\/a>\u00a0a 2020 ruling from Trump\u2019s ustice Department\u2019s Office of Legal Council that stated that the \u201cthe ratification deadline established by Congress for the ERA is valid and enforceable.\u201d<\/p>\n<p>Biden, though, is citing the far-left American Bar Association\u2019s (ABA) opinion\u00a0<a href=\"https:\/\/www.cnn.com\/2025\/01\/17\/politics\/joe-biden-equal-right-amendment\/index.html\">according to<\/a>\u00a0CNN. The ABA claims \u201cno time limit was included in the text of the Equal Rights Amendment\u201d and \u201cthe Constitution\u2019s framers wisely avoided the chaos that would have resulted if states were able to take back the ratifying votes at any time.\u201d<\/p>\n<p>NPR\u00a0<a href=\"https:\/\/www.npr.org\/2025\/01\/17\/nx-s1-5264378\/biden-era-national-archivist-constitution\">notes<\/a>\u00a0that for Biden\u2019s move to have the force of law, it would need to be formally published or certified to come into effect by the National Archivist, Colleen Shogan. It\u2019s not clear if this would happen and the Biden regime claims they will not force the archivist to certify and publish the ERA (no one should believe them, of course).<\/p>\n<p>The ERA is a radical amendment ostensibly designed to give men and women \u2018equality\u2019 under the Constitution, but in reality, it would unleash a series of potentially devastating consequences for America. Two years ago, the Senate GOP\u00a0<a href=\"https:\/\/www.kennedy.senate.gov\/public\/2023\/3\/kennedy-hyde-smith-introduce-resolution-to-stop-equal-rights-amendment-from-illegitimate-ratification\">introduced\u00a0<\/a>an effort to stop the illegitimate ratification of the ERA while outlining these facts.<\/p>\n<p>These\u00a0<a href=\"https:\/\/www.kennedy.senate.gov\/public\/2023\/3\/kennedy-hyde-smith-introduce-resolution-to-stop-equal-rights-amendment-from-illegitimate-ratification\">include<\/a>:<\/p>\n<p>\u2022 Legalizing abortion on demand.<br \/>\n\u2022 Prohibiting schools from allowing separate-sex athletic teams.<br \/>\n\u2022 Prohibiting separate prisons for male and female prisoners.<br \/>\n\u2022 Prohibiting separate public restrooms for males and females.<br \/>\n\u2022 Requiring women to register for the draft.<br \/>\n\u2022 Requiring public funding for sex-reassignment surgeries based on the argument that denying coverage would constitute sex discrimination.<br \/>\n\u2022 Requiring doctors to provide puberty blockers to children who claim to identify as transgender.<br \/>\n\u2022 Prohibiting religious organizations from having single-sex membership.<\/p>\n<\/blockquote>\n<p>This is the most shameful parting gift that Biden could have given the country.
