The First Circuit Court of Appeals on Tuesday (for now) sided with the Biden judge who blocked the Trump Administration from dismantling the Department of Education. <\/p>\n

Last Thursday a federal judge blocked <\/a>the Trump administration from dismantling the department of education.<\/p>\n

In March, President Trump signed an executive order to dismantle the Department of Education.<\/p>\n

\u201cWe\u2019ve got to get the federal government out of education,\u201d Trump declared. \u201cThe Department of Education has become a bloated bureaucracy that\u2019s more interested in pushing its own agenda than in helping our kids learn. It\u2019s time to put the power back in the hands of parents, teachers, and local communities.\u201d<\/p>\n

US District Judge Myong Joun, a Biden appointee, issued an injunction blocking the Trump Administration from laying off Department of Education workers last Thursday.<\/p>\n

\u201cThis case arises out of an attempt by Defendants to shut down the Department without Congressional approval,\u201d the judge wrote.<\/p>\n

Judge Joun ordered the Trump Administration to reinstate the Department of Education workers.<\/p>\n

The Trump DOJ appealed Judge Joun\u2019s injunction and the First Circuit Court of Appeals denied their request for an immediate administrative stay.<\/p>\n

However, the appeals court said it intends to rule on the DOJ\u2019s request for a stay pending appeal promptly.<\/p>\n
