As questions swirl about Joe Biden\u2019s cognitive state and absentee leadership, new scrutiny is falling on the use of the presidential autopen by Biden\u2019s staffers, an automated signature device that has been used to sign executive orders and potentially even pardons.<\/p>\n

These staffers, if these reports are accurate, could have engaged in multiple ongoing felonies.<\/p>\n

House Oversight Chair Jim Comer (R-KY) has said legislative subpoenas are being sent out<\/a>, but what crimes could they be pursuing? And something many are asking online: will anyone ever be charged with any crimes?<\/p>\n

Nearly all of Biden\u2019s official signatures were done with the autopen<\/a>. The Biden White House even issued criminal pardons with the autopen<\/a>. There were two autopens<\/a> that were in use.<\/p>\n

The OversightPR project<\/a> identified times that Biden\u2019s pardons were issued while Joe Biden was known to be out of the White House on vacation<\/a> and unable to run the automatic signature machine.<\/p>\n

Project Veritas released a video today showing David Hogg admitting that it was Jill Biden\u2019s Chief of Staff who was exerting a tremendous amount of unseen power<\/a> in the Biden White House.<\/p>\n

Trump has said whoever was using the autopen was \u201cusurping the power of the Presidency.\u201d<\/a><\/p>\n

Who was running the American government under Sleepy Joe Biden?<\/em><\/strong><\/p>\n

If reports are accurate that White House staff may have used Biden\u2019s autopen to execute official acts without his direct knowledge or consent, the legal implications are not just alarming, they\u2019re criminal acts.<\/p>\n

Biden issued wide-ranging pardons in his last weeks, including a controversial one for his controversial son Hunter<\/a>, despite promising previously that he would not pardon Hunter. Reports now coming out that Hunter exercised a great deal of power in the Biden White House has some wondering whether Hunter simply issued his own pardon without Joe Biden knowing.<\/p>\n

Here\u2019s what relevant federal law says: if anyone in the Executive Office signed legal documents such as pardons, executive orders, diplomatic communications without the President\u2019s full and current awareness, they would likely violate multiple federal statutes, including:<\/p>\n

18 U.S.C. \u00a7 471<\/a> \u2013 Forgery of United States Documents<\/strong>
\nIt is a crime to falsely make or use any writing for the purpose of defrauding the United States. Signing the President\u2019s name via autopen on legal instruments without his direct authorization is a textbook example. Maximum penalty: 20 years in prison.<\/p>\n

18 U.S.C. \u00a7 912<\/a> \u2013 Impersonation of a Federal Officer<\/strong>
\nPretending to be the President\u2014even indirectly by authorizing acts in his name, while exercising that power, unlawfully carries up to 3 years in prison.<\/p>\n

18 U.S.C. \u00a7 1001<\/a> \u2013 False Statements<\/strong>
\nAny deception involving a material act of government, especially in formal documents, exposes the staffer(s) to 5\u20138 years in prison per count.<\/p>\n

18 U.S.C. \u00a7 371<\/a> \u2013 Conspiracy to Defraud the United States<\/strong>
\nIf multiple officials coordinated such actions, even internally, it may be prosecutable as conspiracy.<\/p>\n

18 U.S.C. \u00a7 1503<\/a>, 1512<\/a> \u2013 Obstruction of Justice<\/strong>
\nIf any falsified pardons were used to derail or stop criminal proceedings, such as the Hunter Biden pardon that stopped his charges and likely sentencing, obstruction charges would apply.<\/p>\n

18 U.S.C. \u00a7 1341<\/a>, 1343<\/a> \u2013 Wire or Mail Fraud<\/strong>
\nThe use of email, phone, or interagency transmissions to process these fraudulent signatures might trigger additional felony charges.<\/p>\n

A key legal question is going to be who knew what, and when? Since Biden\u2019s cognitive decline was obvious to anyone paying attention, and Justice Department Attorney Robert Hur even noted it in his write-up of Biden\u2019s mishandling of classified documents, it is hard to claim that many were not aware that this was going on.<\/p>\n

The 25th Amendment to the Constitution, passed in 1967, was created to deal with the situation of an incapacitated President. Particularly Section 4 contains the constitutional process designed to address a situation where a sitting President is unable or unfit to discharge the duties of office, but is either unwilling or unable to voluntarily step aside. It allows the Vice President and a majority of the Cabinet to declare the President incapacitated and install the VP as Acting President.<\/p>\n

If Biden\u2019s decline was \u2018stage-managed\u2019 in order to prevent the Cabinet secretaries from being able to observe his mental incapacity, then the staffers involved could be liable for participating in a criminal conspiracy.<\/p>\n

Biden\u2019s Press Secretary Jen Psaki claims she never noticed Biden\u2019s mental decline<\/a> until his May 2024 debate with Trump.<\/p>\n

But the Gateway Pundit reported in June 2021 that Biden was speaking gibberish and appeared totally lost<\/a>. The Gateway Pundit reported in 2020 that it was obvious Biden had dementia<\/a>. Biden falsely said he was arrested during the Civil Rights movement<\/a>. Biden falsely claimed in 2021 that he desegregated restaurants<\/a> during the Civil Rights movement.<\/p>\n

On the 2020 campaign trail, Biden told insane, obviously-false<\/a>, stories about himself.<\/p>\n

Even as far back as 2017, Biden invented an incoherent story about growing up with a villain named \u201cCorn Pop\u201d<\/a> at a local swimming pool. The Washington Post went and \u2018investigated\u2019 this senile lie, this obviously-false story by Biden, and rated it \u201ctrue<\/a>.\u201d It appears they were part of the effort to keep Biden\u2019s obvious mental decline protected from scrutiny.<\/p>\n

Those White House staffers who participated in the cover-up would be potentially liable for being conspirators.<\/p>\n

18 U.S.C. \u00a7 371<\/a> \u2013 Conspiracy to Defraud the United States<\/strong><\/p>\n

\u201cIf two or more persons conspire either to commit any offense against the United States, or to defraud the United States, and one or more of such persons do any act to effect the object of the conspiracy\u2026\u201d<\/em><\/p>\n<\/blockquote>\n

This statute doesn\u2019t just require someone to do the illegal act, it criminalizes the agreement and coordination to make it happen. Even if one person \u201cpresses the button,\u201d those who helped plan, cover up, or enable it are liable.<\/p>\n

This could involve personal liability for several key Biden staffers who were in a position of power and trust within the White House, including:<\/p>\n
