The Court of International Trade in New York on Wednesday said President Trump exceeded his authority to impose tariffs under the International Emergency Economic Powers Act of 1977 (IEEPA).<\/p>\n

\u201cThe order halts Trump\u2019s 30% tariffs on China, his 25% tariffs on some goods imported from Mexico and Canada, and the 10% universal tariffs on most goods coming into the United States. It does not, however, affect the 25% tariffs on autos, auto parts, steel or aluminum, which were subject to Section 232 of the Trade Expansion Act \u2013 a different law than the one Trump cited for his broader trade actions,\u201d CNN reported<\/a>.<\/p>\n

Last week US District Court Judge T. Kent Wetherell suggested<\/a> President Trump had the authority to impose tariffs under IEEPA, a ruling from the 1970s, but did not issue an order.<\/p>\n

\u201cAccording to the judge, the International Emergency Economic Powers Act of 1977 gives Trump the authority to set tariffs for reasons other than raising revenue. Wetherell wrote that Trump\u2019s justification for the tariffs \u2014 both stemming the flow of illicit drugs into the country and resolving a trade imbalance \u2014 is sufficient to satisfy the terms set by Congress,\u201d ABC News reported <\/a>last week.<\/p>\n

However, rather than issuing an order, Judge Wetherell punted the case from a federal court in Southern Florida to the Court of International Trade.<\/p>\n

The judge transferred one of the lawsuits to the federal court in New York.<\/p>\n

On Wednesday, a three-judge panel at the US Court of International Trade ruled<\/a> President Trump exceeded his authority to unilaterally impose tariffs under IEEPA. <\/p>\n

The three judge panel including: Gary Katzmann (Obama), Timothy Reif (Trump) and Jane Restani (Reagan). <\/p>\n

\u201cA three-judge panel at the US Court of International Trade, a relatively low-profile court in Manhattan, ruled Wednesday to temporarily halt Trump\u2019s global tariffs that he imposed citing emergency economic powers, including his \u201cLiberation Day\u201d tariffs imposed on April 2,\u201d CNN reported<\/a>.<\/p>\n

\u201cThe court ruled in favor of a permanent injunction, grinding Trump\u2019s global tariffs to a halt before \u201cdeals\u201d with most other trading partners have even been reached. That means the bulk \u2013 but not all \u2013 of Trump\u2019s tariffs are put in a standstill,\u201d CNN reported.<\/p>\n

The Trump Administration swiftly appealed <\/a>the ruling.<\/p>\n
