{"id":52841,"date":"2025-08-24T19:39:24","date_gmt":"2025-08-24T19:39:24","guid":{"rendered":"https:\/\/sasquatchnewsonline.com\/?p=52841"},"modified":"2025-08-24T19:39:24","modified_gmt":"2025-08-24T19:39:24","slug":"how-congress-can-implement-president-trumps-election-reform-movement-and-usher-in-hand-marked-hand-counted-paper-ballots-at-the-precinct-level","status":"publish","type":"post","link":"https:\/\/sasquatchnewsonline.com\/?p=52841","title":{"rendered":"How Congress Can Implement President Trump\u2019s Election Reform Movement and Usher in Hand-marked, Hand-counted Paper Ballots at the Precinct Level"},"content":{"rendered":"<p><img data-recalc-dims=\"1\" decoding=\"async\" width=\"640\" height=\"336\" src=\"https:\/\/i0.wp.com\/www.thegatewaypundit.com\/wp-content\/uploads\/2025\/08\/screenshot-2025-08-14-at-2.35.53pm-1200x630.jpg?resize=640%2C336&#038;ssl=1\" class=\"webfeedsFeaturedVisual wp-post-image\" alt=\"\" loading=\"lazy\" \/><\/p>\n<figure aria-describedby=\"caption-attachment-1437586\" class=\"wp-caption alignnone\"><img data-recalc-dims=\"1\" decoding=\"async\" loading=\"lazy\" class=\"size-facebook wp-image-1437586\" src=\"https:\/\/i0.wp.com\/www.thegatewaypundit.com\/wp-content\/uploads\/2025\/08\/screenshot-2025-08-14-at-2.35.53pm-1200x630.jpg?resize=640%2C336&#038;ssl=1\" alt=\"\" width=\"640\" height=\"336\" \/><figcaption class=\"wp-caption-text\">Screenshot: The White House<\/figcaption><\/figure>\n<p>Last week, President Trump declared that he is leading \u201ca movement to get rid of mail-in ballots\u201d and \u201chighly \u2018inaccurate,\u2019 very expensive, and seriously controversial voting machines,\u201d claiming that they cost ten times more than \u201caccurate and sophisticated watermark paper.\u201d<\/p>\n<p>President Trump then made a controversial claim:\u00a0 \u201cthe States are merely an \u2018agent\u2019 for the Federal Government in counting and tabulating the votes\u201d and that \u201cthey must do what the Federal Government\u2026tells them\u2026to do.\u201d<\/p>\n\n<p>Anti-federalists would shockingly align with Voting \u2018Rights\u2019 NGOs, who seem to suffer from Trump Derangement Syndrome quite often, and cry out \u201cthe state legislatures were prescribed this authority!\u201d<\/p>\n<div class=\"tgp-post-inline-1\">\n<div class=\"adcovery-postinline-01\"><\/div>\n<\/div>\n<p>This is of course in reference to Article 1 Section 4, generally called the Elections Clause.\u00a0 And while that is fundamentally correct, it is also only one of two aspects to the Elections Clause and omits that the U.S. Congress still preempts the states\u2019 legislatures.<\/p>\n<p>Art. 1, Sec 4 states:<\/p>\n<blockquote>\n<p>The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of [choosing] Senators.<\/p>\n<\/blockquote>\n<p>Using Congress\u2019s authority under the Elections Clause, there is a simple way that they can restore faith in the elections, streamline their efficiency while bolstering their effectiveness, and ensure the American people that their voice is being heard, at least in federal elections.<\/p>\n<h3>The Precedent<\/h3>\n<p>In the 1932 case <em>Smiley v. Holm<\/em>, arguments were heard on whether the state legislature of Minnesota had the authority to redistrict the state without the approval of the governor based on the Elections Clause.\u00a0 <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/285\/355\">In his opinion,<\/a> <span>Chief Justice Hughes outlined several of the authorities that were entrusted to the state legislatures, but also that the U.S. Congress has the ability to \u201csupplement\u201d or \u201csubstitute\u201d its own regulations:<\/span><\/p>\n<blockquote>\n<p>The subject-matter is the \u2018times, places and manner of holding elections for senators and representatives.\u2019 It cannot be doubted that these comprehensive words embrace authority to provide a complete code for congressional elections, not only as to times and places, but in relation to notices, registration, supervision of voting, protection of voters, prevention of fraud and corrupt practices, counting of votes, duties of inspectors and canvassers, and making and publication of election returns\u2026<\/p>\n<p>\u2026The phrase \u2018such regulations\u2019 plainly refers to regulations of the same general character that the legislature of the State is authorized to prescribe with respect to congressional elections. In exercising this power, the Congress may supplement these state regulations or may substitute its own. It may impose additional penalties for the violation of the state laws or provide independent sanctions. It \u2018has a general supervisory power over the whole subject.\u2019<\/p>\n<\/blockquote>\n<p>In 1997, the Supreme Court upheld this \u2018supervisory power\u2019 in\u00a0<em>Foster v. Love<\/em>.\u00a0 Justice Souter was joined by Justices Scalia, Kennedy, and Thomas in the opinion that:<\/p>\n<blockquote>\n<p>The [Elections] Clause is a default provision; it invests the States with responsibility for the mechanics of congressional elections but only so far as Congress declines to pre-empt state legislative choices. Thus, it is well settled that the Elections Clause grants Congress \u2018the power to override state regulations\u2019 by establishing uniform rules for federal elections, binding on the States. \u2018The regulations made by Congress are paramount to those made by the State legislature; and if they conflict therewith, the latter so far as the conflict extends, ceases to be operative.\u2019<\/p>\n<\/blockquote>\n<p>In <a href=\"https:\/\/digitalcommons.law.uw.edu\/cgi\/viewcontent.cgi?article=5183&amp;context=wlr&amp;utm_source=perplexity\">a 2021 Washington Law Review<\/a> by Eliza Sweren-Becker and Michael Waldman titled, \u201cThe Meaning, History, and Importance of the Elections Clause,\u201d the authors described the Elections Clause as:<\/p>\n<blockquote>\n<p>\u201c\u2026a provision of extraordinary, if often latent power.\u00a0 Nowhere else in the original Constitution is Congress given explicit authority to \u201calter\u201d state laws even absent a conflicting federal statute.\u00a0 It is also one of the few places in the Constitution where states are given an explicit instruction to act \u2013 in this case, to ensure the continuation of the federal legislature.\u201d<\/p>\n<\/blockquote>\n<h3>The Public<\/h3>\n<p>Faith in our elections is plummeting.\u00a0 Recent polling shows that public trust in the integrity of our elections has fallen off significantly.\u00a0 In an article from Ryan Shandler, a Georgia Tech Professor of Cybersecurity and International Relations, he <a href=\"https:\/\/www.gatech.edu\/news\/2025\/06\/27\/cyberattacks-shake-voters-trust-elections-regardless-party\">writes<\/a>:<\/p>\n<blockquote>\n<p>Nearly half of Americans, both Democrats and Republicans, question whether elections are\u00a0<a href=\"https:\/\/news.gallup.com\/poll\/651185\/partisan-split-election-integrity-gets-even-wider.aspx\">conducted fairly<\/a>. Some voters accept election results only\u00a0<a href=\"https:\/\/worldjusticeproject.org\/our-work\/research-and-data\/rule-law-united-states\">when their side wins<\/a>. The problem isn\u2019t just political polarization \u2013 it\u2019s a creeping\u00a0<a href=\"https:\/\/www.pewresearch.org\/politics\/2018\/10\/29\/elections-in-america-concerns-over-security-divisions-over-expanding-access-to-voting\/\">erosion of trust<\/a> in the machinery of democracy itself.<\/p>\n<p>Commentators blame ideological tribalism,\u00a0<a href=\"https:\/\/www.nytimes.com\/2024\/01\/09\/business\/media\/election-disinformation-2024.html\">misinformation campaigns<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.nytimes.com\/2022\/06\/15\/opinion\/social-media-polarization-democracy.html\">partisan echo chambers<\/a>\u00a0for this crisis of trust. But these explanations miss a critical piece of the puzzle: a growing unease with the digital infrastructure that now underpins nearly every aspect of how Americans vote.<\/p>\n<\/blockquote>\n<p>In <a href=\"https:\/\/heartland.org\/opinion\/heartland-rasmussen-poll-large-majority-of-voters-62-are-concerned-cheating-will-impact-2024-election\/\">a July 2024 poll<\/a> from Rasmussen Reports\/Heartland Institute, 62% of likely voters are concerned cheating would affect the outcome of the 2024 election, with 37% \u201cvery concerned\u201d and only 15% \u201cnot at all concerned.\u201d<\/p>\n<p>Another <a href=\"https:\/\/www.rasmussenreports.com\/public_content\/politics\/biden_administration\/election_integrity_measures_enjoy_broad_support\">Rasmussen Reports poll<\/a> from November 18th, 2024, following the 2024 Presidential Election, 65% of voters \u201cbelieve disputes over election results should be investigated fully, including the use of forensic ballot audits\u201d and that \u201c59% say <strong>federal election laws should require the use of paper ballots.\u201d<\/strong><\/p>\n<p>Matt Blaze, the McDevitt Chair of Computer Science and Law at Georgetown University, just this month called voting machines \u201cunreliable,\u201d \u201cthe hardest technical problem in computer science that [he\u2019s] ever encountered <strong>bar none<\/strong>\u201d and said that \u201cwe don\u2019t know how to build complex software\u2026in ways that actually assure us that they do what we intend them to do.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-media-max-width=\"560\">\n<p dir=\"ltr\" lang=\"en\">Election machines must go. Period.<\/p>\n<p>Here\u2019s some clips of Georgetown Professor Matt Blaze during the most recent DefCon Voting Village 2025:<\/p>\n<p>First, US Elections are the \u201chardest technical problem in computer science that [he\u2019s] ever encountered bar none.\u201d<\/p>\n<p>That\u2019s a crazy\u2026 <a href=\"https:\/\/t.co\/HgZeRml8EV\">pic.twitter.com\/HgZeRml8EV<\/a><\/p>\n<p>\u2014 CannCon (@CannConActual) <a href=\"https:\/\/twitter.com\/CannConActual\/status\/1959639659509694899?ref_src=twsrc%5Etfw\">August 24, 2025<\/a><\/p>\n<\/blockquote>\n<blockquote class=\"twitter-tweet\" data-media-max-width=\"560\">\n<p dir=\"ltr\" lang=\"en\">\u201cSoftware is vulnerable\u201d (duh).<\/p>\n<p>But admitting \u201cwe don\u2019t know how to build complex software\u201d that \u201cactually assure us they do what we intend them to do\u201d<\/p>\n<p>But sure\u2026let\u2019s use them to \u2018elect\u2019 our representatives and control a $26 Trillion economy! <a href=\"https:\/\/t.co\/E7nH79i5au\">pic.twitter.com\/E7nH79i5au<\/a><\/p>\n<p>\u2014 CannCon (@CannConActual) <a href=\"https:\/\/twitter.com\/CannConActual\/status\/1959639661812367658?ref_src=twsrc%5Etfw\">August 24, 2025<\/a><\/p>\n<\/blockquote>\n<h3>The Proposal<\/h3>\n<p>The solution is simple.\u00a0 Pass a bill that requires states to separate their state and local elections from federal elections.\u00a0 The bill should include requirements to count the federal ballots under public live-stream at the precinct level.<\/p>\n<p>Volunteers consisting of members from all parties involved from within the community can assist with the counting, under quality live-stream supervision<span>.\u00a0 This would limit the possible number of ballots with 100% turnout to around 2,000 ballots with, at most, three races on them: US House, Senate, and President.<\/span><\/p>\n<p>Under federal law, <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/2\/7\">2 U.S. Code \u00a7 7<\/a> states that:<\/p>\n<blockquote>\n<div class=\"content\">\n<p>The Tuesday next after the 1st Monday in November, in every even numbered year, is established as the day for the election, in each of the States and Territories of the United States, of Representatives and Delegates to the\u00a0Congress\u00a0commencing on the 3d day of January next thereafter.<\/p>\n<\/div>\n<\/blockquote>\n<p>Several state constitutions, like Florida for example (Art. VI, \u00a7 5), reaffirm the federal mandate, while others hold their local and state elections on different days throughout the year.<\/p>\n<p>Still, Congress can pass a law that requires states to use a separate ballot for federal elections, which will never be more than three choices (perhaps four in extenuating circumstances where two Senators are eligible due to a resignation or death).<\/p>\n<p>One of the most parroted talking points from hand-counted paper ballot critics is the complexity of the election, sometimes having dozens of races on a single ballot.<\/p>\n<p>With this streamlined approach, the excuses ushered in by paper-ballot critics are moot.\u00a0 At least for the federal races.\u00a0 And let\u2019s face it:\u00a0 election night coverage focuses primarily on the President, the Senate, and Congress.\u00a0 Gubernatorial races are often second to those three federal offices.<\/p>\n<p>The argument that this creates an increased burden on election officials at the local level also falls flat.\u00a0 It can be conducted simultaneously with state and local elections, however, separating the elections would help ensure more educated voters are engaged in the governments that affect them the most: local government.<\/p>\n<p>How often does a voter show up to vote for, say, President Trump or Joe Biden, and then ends up filling in bubbles for anyone with the corresponding D or R next to their name in alignment with their top-of-ticket picks?<\/p>\n<p>According to <a href=\"https:\/\/hub.jhu.edu\/2018\/12\/14\/americans-dont-understand-state-government\/\">a 2018 survey<\/a> from Johns Hopkins University, a third of respondents didn\u2019t know which state officials they voted for beyond governor, lieutenant governor, and members of the legislature.\u00a0 <a href=\"https:\/\/www.governing.com\/archive\/gov-americans-knowledge-state-government.html\">Nearly 33% didn\u2019t know who their governor was and 80% don\u2019t know who their representative in the state legislature was.<\/a><\/p>\n<div class=\"border-borderMain\/50 ring-borderMain\/50 divide-borderMain\/50 bg-transparent\">\n<div class=\"gap-y-sm md:gap-y-md flex flex-col\">\n<div class=\"relative font-sans text-base text-foreground selection:bg-super\/50 selection:text-foreground dark:selection:bg-super\/10 dark:selection:text-super\">\n<div class=\"min-w-0 break-words [word-break:break-word]\">\n<div class=\"gap-y-md after:clear-both after:block after:content-['']\" dir=\"auto\">\n<div class=\"relative\">\n<div class=\"prose text-pretty dark:prose-invert inline leading-relaxed break-words min-w-0 [word-break:break-word] prose-strong:font-medium\">\n<p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">When PACs, Super PACs, and fundraising platforms like ActBlue and WinRed amplify name recognition without delivering substantive knowledge, a cloud of influence descends.\u00a0 This disconnect between visibility and understanding undermines democratic accountability: well-funded candidates and organizations can dominate the airwaves and shape perceptions, yet voters often cast ballots in a fog of unfamiliarity.<\/p>\n<p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">The result? Voters may inadvertently endorse candidates whose policies and records remain opaque, making the ballot less a tool of informed self-government and more a reflection of campaign spending and partisan inertia.<\/p>\n<p>This is also one of the most significant underlying reasons establishment politicians and bureaucrats will dismiss this idea but they\u2019ll do it under the masquerade of \u2018it makes the election officials jobs more difficult and their job is already really stressful!\u2019<\/p>\n<p>Whether or not Congress can pass laws requiring state and local races to also utilize hand-marked paper ballots hand-counted at the precinct level is debatable.\u00a0 However, given the turn out numbers historically, the separation of federal from state elections would further ease the burden on local election offices.<\/p>\n<p>Traditionally, federal elections garner turnout around 60-67% when a presidential race is on the ballot.\u00a0 This number drops off to 40-50% for midterm elections for the U.S. House and Senate.\u00a0 However, the largest drop off comes with local elections.\u00a0 According to Ballotpedia, turnout for these elections range from 8-20%.<\/p>\n<\/div>\n<p>In this moment of deepening mistrust in American elections, it is imperative that Congress acts boldly to restore confidence and safeguard the integrity of our republic. President Trump\u2019s proposal to eliminate voting machines in favor of hand-marked, publicly hand-counted paper ballots offers a pathway toward transparent, citizen-powered elections that leave no room for doubt or digital manipulation.<\/p>\n<p>By separating federal ballots, requiring live-streamed precinct-level counts, and involving volunteers from across the political spectrum, voters can reclaim control of the electoral process for the people themselves\u2014not for companies, code, or partisan vendors. No technical fix or incremental audit can restore the sense of trust that only honest, visible tabulation can provide.<\/p>\n<p>With Congress\u2019s clear constitutional authority to regulate federal elections, passing such a law is not only feasible but just and vital.
