Lisa Cook filed a lawsuit<\/a> after President Trump fired her as Federal Reserve Governor \u2013 and the lawsuit was assigned to a Biden-appointed judge.<\/p>\n

Cook is suing President Trump, the Federal Reserve Board of Governors, and Fed Chairman Jerome Powell.<\/p>\n

President Trump on Monday evening\u00a0fired\u00a0<\/a>Biden-appointed Federal Reserve Governor Lisa Cook amid mortgage fraud allegations.<\/p>\n

\u201cPursuant to my authority under Article II of the Constitution of the United States and the Federal Reserve Act of 1913, as amended, you are hereby removed from your position on the Board of Governors of the Federal Reserve, effective immediately,\u201d President Trump wrote in a letter to Lisa Cook.<\/p>\n

\u201cI have determined that there is sufficient cause to remove you from your position,\u201d Trump added as he cited housing regulator Bill Pulte\u2019s criminal referral on Lisa Cook for mortgage fraud \u2013 specifically occupancy fraud.<\/p>\n

According to housing regulator Bill Pulte\u2019s criminal referral, Lisa Cook committed mortgage fraud by lying on her mortgage application and falsifying bank statements when she designated her out-of-state Atlanta condo as her \u201cprimary residence\u201d\u2014just two weeks after taking a loan on her Michigan home, which she also claimed as her \u201cprimary residence.\u201d<\/p>\n

By claiming \u201cprimary residence\u201d on her out-of-state condo, Lisa Cook received more favorable loan terms and a lower interest rate.<\/p>\n

\u201cWe have obtained a document Lisa Cook submitted to the U.S. Government while serving as Federal Reserve Governor. In it, on February 28, 2023, she represents to the U.S. Government that the Atlanta Property is her PERSONAL RESIDENCE,\u201d Pulte said.<\/p>\n

\u201cHowever, Lisa Cook, as a then-sitting Fed Governor and six months earlier, on September 1, 2022, appears to have listed that same property for RENT,\u201d Pulte added.<\/p>\n

Lisa Cook did not appear to refute the allegations of mortgage fraud, but she did argue that she is the first black woman to sit on the federal reserve\u2019s board in its history.<\/p>\n

\u201cGovernor Cook is the first Black woman to sit on the Federal Reserve\u2019s Board in its 111-year history,\u201d the lawyers wrote.<\/p>\n

\u201cThis case challenges President Trump\u2019s unprecedented and illegal attempt to remove Governor Cook from her position which, if allowed to occur, would the first of its kind in the Board\u2019s history. It would subvert the Federal Reserve Act (\u201cFRA\u201d), which explicitly requires a showing of \u201ccause\u201d for a Governor\u2019s removal, which an unsubstantiated allegation about private mortgage applications submitted by Governor Cook prior to her Senate confirmation is not,\u201d Cook\u2019s attorneys wrote in the complaint <\/a>reviewed by The Gateway Pundit.<\/p>\n

Lisa Cook\u2019s attorneys argued that President Trump violated Cook\u2019s Fifth Amendment due process rights.<\/p>\n

They also cited Humphrey\u2019s Executor and said the Supreme Court \u201cunanimously upheld the constitutionality of such statutory protections for government officials serving on multi-member agencies.\u201d<\/p>\n

\u201cIn Humphrey\u2019s Executor, the Court found that Congress has the authority to restrict presidential removals \u201cdepend[ing] upon the character of the office,\u201d\u201d they wrote.<\/p>\n

Justice Clarence Thomas previously blasted the 1935 decision known as Humphrey\u2019s Executor.<\/p>\n

\u201cHumphrey\u2019s Executor poses a direct threat to our constitutional structure and, as a result, the liberty of the American people . . . Our tolerance of independent agencies in Humphrey\u2019s Executor is an unfortunate example of the Court\u2019s failure to apply the Constitution as written. That decision has paved the way for an ever-expanding encroachment on the power of the Executive, contrary to our constitutional design,\u201d Justice Thomas wrote<\/a>.<\/p>\n
