This federal law guarantees parents the right to exempt their children from surveys that ask for sensitive, private information.<\/p>\n<p>The YRBS, administered to students at Marshall Simonds Middle School and Burlington High School in March, included explicit questions on topics like drug and alcohol use, mental health, sexual encounters, sexual orientation, and \u201cgender identity.\u201d<\/p>\n<p>Parents were notified in advance about their opt-out rights, and several submitted written requests to exclude their children from the survey. Despite this, the district allegedly required the opted-out students to take it anyway, with at least one teacher reportedly forcing a student to participate over clear objections.<\/p>\n<div class=\"tgp-post-inline-1\">\n<div class=\"adcovery-postinline-01\"><\/div>\n<\/div>\n<p>Screenshots of the survey questions, <a href=\"https:\/\/mafamily.org\/wp-content\/uploads\/2025\/08\/Burlington-Survey-Screenshots-and-Letter_Redacted.pdf\">provided in a complaint<\/a> filed by the Massachusetts Family Institute (MFI) and parents, reveal the invasive nature of the content.<\/p>\n<p>Examples include:<\/p>\n<ul>\n<li>Questions on sexual orientation, with options like \u201cstraight,\u201d \u201clesbian,\u201d \u201cgay,\u201d \u201casexual,\u201d \u201cbisexual,\u201d \u201cpansexual,\u201d and \u201cqueer.\u201d<\/li>\n<li>Gender identity queries, asking students if they identify as \u201ccisgender girl\/woman,\u201d \u201ccisgender boy\/man,\u201d \u201ctransgender girl\/woman,\u201d \u201ctransgender boy\/man,\u201d or \u201cnonbinary\/genderqueer.\u201d<\/li>\n<li>Explicit details on sexual intercourse, defining it to include \u201cvaginal, oral, and anal sex\u201d and the use of \u201ctoys or props.\u201d<\/li>\n<li>Inquiries about forced sexual acts and the age of first alcohol consumption, with options as young as \u201c8 years old or younger.\u201d<\/li>\n<li>Flavors of tobacco products used, such as \u201cfruit,\u201d \u201calcohol,\u201d \u201ccandy,\u201d \u201cmint,\u201d \u201cmenthol,\u201d \u201cwintergreen,\u201d \u201cclove,\u201d or \u201cspice.\u201d<\/li>\n<\/ul>\n<p>These questions were deemed \u201cgraphic and downright inappropriate\u201d by U.S. Secretary of Education Linda McMahon, who blasted the district\u2019s actions.<\/p>\n<p>\u201cParents must be the primary decision-makers in their children\u2019s education. The allegations that Burlington violated parents\u2019 rights by administering a survey against parents\u2019 wishes \u2013 and particularly one that is graphic, and downright inappropriate in nature \u2013 is unconscionable,\u201d said U.S. Secretary of Education Linda McMahon in a <a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/us-department-of-education-initiates-investigation-burlington-public-schools-allegedly-violating-parental-rights\">press release<\/a> about the case. \u201cThe Department will investigate this matter thoroughly and continue to resolutely defend parents\u2019 rights.\u201d<\/p>\n<p>The complaint, <a href=\"https:\/\/mafamily.org\/wp-content\/uploads\/2025\/08\/Burlington-Survey-Screenshots-and-Letter_Redacted.pdf\">detailed in a letter<\/a> by Sam Whiting, Counsel at Massachusetts Liberty Legal Center, on behalf of parents, highlights Burlington\u2019s alleged history of pushing radical ideologies without opt-out options. It references past incidents, such as promoting LGBTQ+ Pride celebrations, racial views, and gender-nonconforming teacher pronoun use, while hiding information like an LGBTQ club from parents.<\/p>\n<p>The letter states:<\/p>\n<blockquote>\n<p>\u201cOrdinarily, a school district that failed to comply with the PPRA might be given some leeway \u2013 federal law can be complex and compliance is, understandably, not always perfect. But this is not the first time that Burlington Public Schools have violated the rights of parents and students. Under the guise of \u2018inclusion\u2019 and \u2018anti-bullying,\u2019 BPS has for years pushed controversial and divisive sexual, racial, and political ideologies upon impressionable students without providing parents with an opportunity to opt their children out. BPS has gone all-out to celebrate \u2018LGBTQ+ Pride,\u2019 decking the halls at school with flags and posters, while denying pro-life students the opportunity to fly the pro-life flag on the school flagpole for even a day in January 2024. It has shown students videos suggesting that all white people view black men as inherently dangerous. \u2018Gender nonconforming\u2019 BPS teachers have pressured students to use pronouns for the teacher that do not match their biological sex. BPS has attempted to hide the existence of an LGBTQ club from parents in order to keep them in the dark about their children\u2019s sexuality.
