Chief Justice John Roberts signaled Wednesday that he might act as a thorn in President Donald Trump\u2019s side.<\/p>\n

During oral arguments over Trump\u2019s effort to end birthright citizenship<\/a>, Roberts pushed back against Solicitor General John Sauer, who made the president\u2019s argument.<\/p>\n

Specifically, Roberts sounded skeptical that the Fourteenth Amendment, on which birthright citizenship rests, excludes children of illegal immigrants.<\/p>\n

\u201cBased on Chinese media reports,\u201d Sauer said in a clip posted to the social media platform X, \u201cthere are 500 \u2014 500 \u2014 birth-tourism companies in the People\u2019s Republic of China, whose business is to bring people here to give birth and return to that nation.\u201d<\/p>\n

\u201cHaving said all that,\u201d Roberts replied, \u201cyou do agree that that has no impact on the legal analysis before us?\u201d<\/p>\n

Sauer did not agree. Instead, he respectfully cited the late Justice Antonin Scalia in arguing that 19th-century Americans did not foresee such things. In other words, the people who wrote the Fourteenth Amendment did not intend it for the children of illegal immigrants.<\/p>\n

\u201cWell, it certainly wasn\u2019t a problem in the 19th century,\u201d Roberts responded.<\/p>\n

\u201cNo,\u201d Sauer replied, \u201cbut of course, we\u2019re in a new world now, as Justice [Samuel] Alito pointed out, where eight billion people are one plane ride away from having a child who\u2019s a U.S. citizen.\u201d<\/p>\n

\u201cWell, it\u2019s a new world,\u201d Roberts conceded, \u201c[but] it\u2019s the same Constitution.\u201d<\/p>\n

Sauer again cited Scalia, at which point the exchange concluded.<\/p>\n

According to Axios<\/a>, Trump made history Wednesday as the first sitting president to attend oral arguments.<\/p>\n

No doubt he recognized Sauer\u2019s argument. After all, the president has made a similar case against what he described as Chinese exploitation of birthright citizenship.<\/p>\n

\u201cThe next thing you know they will rule in favor of China and others, who are making an absolute fortune on Birthright Citizenship, by saying the 14th Amendment was NOT written to take care of the \u2018babies of slaves,\u2019 which it was as proven by the EXACT TIMING of its construction, filing, and ratification, which perfectly coincided with the END OF THE CIVIL WAR,\u201d a frustrated Trump<\/a> wrote in February on his social media platform, Truth Social.<\/p>\n

Furthermore, according to podcaster and SCOTUS reporter Jimmy Hoover, Roberts called Bauer\u2019s argument \u201cquirky.\u201d<\/p>\n

Through it all, Roberts and Justice Amy Coney Barrett<\/a> have acted as swing votes. If Roberts\u2019 exchange with Sauer serves as any indication, that might prove true again.<\/p>\n
